Ticket purchase regulations

1. DEFINITIONS

1.1. Terms and Conditions – means these terms and conditions of purchasing and booking of tickets to screening rooms Morskie Oko, Goplana and Warszawa located in Gdynia Film Centre in Gdynia and Screening Rooms located in Helios in Gdynia, the screening room in the Museum of the Polish Navy in Gdynia, the Consulate of Culture and City Theatre, as well as to the New Stage and Chamber Stage of Musical Theatre in Gdynia via the website www.system.festiwalgdynia.pl and providing the services by electronic means. These terms and conditions are the terms and conditions referred to in Article 8 of the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws of 2002 No 144, item 1204 as amended).

1.2. Website – signifies the website accessible at www.system.festiwalgdynia.pl, the administrator of which is the Service Provider.

1.3. Service Provider – Pomeranian Film Foundation in Gdynia based in Gdynia at Plac Grunwaldzki 2, 81-372 Gdynia, entered in the register of associations, other social and professional organisations, foundations and independent public health care centres and in the register of entrepreneurs kept by the District Court Gdańsk-Północ in Gdansk, VIII Commercial Division of the National Court Register under the KRS number (National Court Register Number): 0000233880, the NIP number (Tax Identification Number): 586-21-47-548, the Regon number (National Business Register Number): 220055893;

1.4. Cinema – signifies the Arthouse Cinema of Gdynia Film Centre located at Plac Grunwaldzki 2, 81-372 Gdynia; Helios cinema in Gdynia located in the Riviera Shopping Centre at Kazimierza Górskiego 2, 81-304 Gdynia; Consulate of Culture at Jana z Kolna 25, 81-001 Gdynia; City Theatre in Gdynia at Bema 26 81-388 Gdynia; Museum of the Polish Navy at Zawiszy Czarnego 1B, 81-374 Gdynia; Chamber Stage and New Stage of Musical Theatre in Gdynia at Plac Grunwaldzki 2, 81-372 Gdynia.

1.5. Ticket – a document issued by the Pomeranian Film Foundation in paper or electronic form, confirming the eligibility to participate in a Screening or an Event, which specifies the title, date and time of the Screening or the Event, and the Screening room. Ticket bought via the Website with e-mail delivery takes the form of a photo code, which is given to the Service User via e-mail;

1.6. Service User – an individual, a legal person or an unincorporated organisational unit, which uses the service provided by electronic means under the terms specified in these Terms and Conditions;

1.7. Payment Website www.dotpay.pl website, administrated by DotpayS.A., based in Krakow, 30-552 Kraków, Wielickiej 72, registered by the District Court Kraków-Śródmieście in Krakow, XI Commercial Division of the National Court Register under the KRS number (National Court Register Number): 0000296790, the NIP number (Tax Identification Number): 634-26-61-860, the NIP EU number (European Tax Identification Number): PL6342661860, the REGON number (National Business Register Number): 240770255;

1.8. Service – service provided by electronic means by the Service Provider via the Website for the Service User, based on these Terms and Conditions.

1.9. Service Agreement – rules for providing Services by the Service Provider and their use by the Service User, which include the rights and obligations of the Service Provider and the Service User, specified in these Terms and Conditions in order to present and record the terms and conditions of providing the Services and the contractual provisions of the Services.

 

2. GENERAL PROVISIONS 

2.1. These terms and conditions specify the rules of purchase of Tickets by the Service Users via the Website and the rules, scope, and terms of use of the Website.

2.2. Terms and conditions are freely available to the Service User via the Website in a way that allows the Service User to view, reproduce, and preserve it at any time. Service User is required to read the Terms and Conditions before using the Services.

2.3. These Terms and Conditions shall be governed by the laws of Poland, in particular the following acts: a) Act of 23 April 1964, the Civil Code, b) Act of 30 May 2014 on Consumer Rights, c) Act of 18 July 2002 on the provision of services by electronic means, hereinafter referred to as the act of provision of services, d) Act of 10 May 2018 on the Protection of Personal Data, e) the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons in regard to processing of personal data and on free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as “GDPR”.

2.4. Contact details for communication between the Service Users and Service Providers are available in the “Contact” tab, which is a subpage of the Website.

2.5. Service User is obliged to use the Website and purchase and redeem Tickets in a manner compliant with the Terms and Conditions and the provisions of applicable law. Service User is prohibited to provide content that violates the generally applicable laws and causes disruption to the operation or overloads the Website.

2.6. Use of the Website requires the following minimum technical conditions:

  1. software: any web browser that supports Java Script, a programme that allows to view and print tickets saved in PDF format;
  2. hardware requirements: device with Internet access.

2.7. Pursuant to these Terms and Conditions, the Service Provider provides the following services on the Website:

  1. Service consisting in the sale to the Service User the Tickets for film screenings at the Cinema – service enabling the purchase of Tickets for film screenings at the Cinema via the Website;
  2. Service consisting in the booking by the Service User the Tickets for film screening at the Cinema – service enabling booking the Tickets for film screenings at Gdynia Film Centre, Helios cinema in Gdynia, Museum of the Polish Navy in Gdynia, Consulate of Culture and City Theatre, as well as for New Stage and Chamber Stage of the Musical Theatre in Gdynia, via the Website.
  3. Service consisting in browsing the content of the Website – Information service that allows the Service User to view information about the repertoire, films, Service Provider, Cinema, educational programmes, upcoming events, festivals, partners, and contact information.

2.8. Electronic services are provided 24 hours a day, 7 days a week.

2.9. In special cases that affect the security of the Website, the Service User, the Service Provider or the stability of the Website, the Service Provider is entitled to discontinue or limit the provision of Services, without prior notice for the time necessary to carry out maintenance work to restore the security and stability of the Website.

2.10. The Service Provider is not responsible for interruptions in the provision of Services resulting from failures or cases of malfunction of the Website beyond the Service Providers control.

2.11. The Service Provider has the right to discontinue the provision of Services in the event of a serious breach by the Service User of the provisions of these Terms and Conditions.

2.12. The conclusion of the Service Agreement for the provision of Tickets for film screenings at the Cinema is made by placing an order via the Website for a Ticket under the conditions laid down in the Terms and Conditions. The condition for the conclusion of the Agreement is acceptance of these Terms and Conditions, which become an integral part of this Agreement. The conclusion of the Service Agreement for the provision of Tickets for film screenings at the Cinema is made by making a reservation via the Website according to the rules specified in the Terms and Conditions. The condition for concluding the Agreement is accepting the content of these Terms and Conditions, which become an integral part of this Agreement.

2.13. The Agreement for provision of the Service consisting in browsing the contents of the Website is concluded after reading the Terms and Conditions and the actual use of this Service. The Agreement for browsing the Website is concluded for the duration of the actual use of the given Service.

 

3. PLACING AN ORDER ON THE WEBSITE FOR THE PURCHASE OF TICKETS FOR FILM SCREENINGS AT THE CINEMA

3.1. In order to purchase tickets for film screenings at the Cinema, you must first register, that is create an account on the Website (www.system.festiwalgdynia.pl.)

3.2. The purchase of a Ticket is made by placing an order for a Ticket through the Website and by making a payment via the Payment Website for the amount due resulting from the order, in accordance with the rules specified in these Terms and Conditions.

3.3. Placing an order is possible under the "Tickets" tab, which is a subpage of the Website. Placing an order is done by performing the following actions on subsequent pages of the Website:

  1. Selecting film screening to which the Ticket applies;
  2. Selecting ”Add to cart”;
  3. Selecting ”Continue”, which redirects to the payment page or ”Add more”, which allows to select tickets for more screenings.
  4. Transcribing the code from the picture;
  5. Submitting a statement of acceptance of these Terms and Conditions and consent to the processing of personal data of the Service User, with the content indicated on the subpage of the Website;
  6. Clicking ”Buy”;
  7. Choosing the delivery of the Ticket in one of the forms specified in paragraph 5.1 of these Terms and Conditions;
  8. Verifying the order;
  9. Placing an order by clicking ”Buy and pay”;
  10. Selecting one of the given payment methods;
  11. Making the payment.

3.4. Payment should be made no later than 30 minutes after placing the order. The expiry of the aforementioned time limit will cause the Website to expire and the ordering procedure will have to be restarted.

3.5. The Service User is entitled to order the Tickets for film screenings from the current repertoire of the Cinema, which will be sold by the Service Provider via the Website.

3.6. The Service Provider shall have the right to decide at their sole discretion when the sale of Tickets for a given film screening via the Website begins and ends, which may differ from the period of time when Tickets are sold at the Cinema ticket offices.

3.7. The Service User is entitled to order no more than 10 tickets in one order.

3.8. When buying a ticket via the Website, the Service User may order only a Regular Ticket. Discount tickets can be purchased at the Cinema ticket offices upon presenting a document entitling to a discount.

3.9. The Service User placing an order will receive a confirmation of its acceptance for processing in the form of an e-mail message, which will be sent to the address provided during the placing of an order. Confirmation of order acceptance will be sent within 5 minutes of receiving the order by the Service Provider. Confirmation of order acceptance will include:

  1. details of the film screening for which the Ticket or Tickets are valid (screening room, date, time),
  2. information on the total price of the service, including the price of Tickets delivery (additional costs),
  3. transaction number.

3.10. The prices shown on the Website, in the order confirmation, and on the Ticket are gross amounts, including VAT calculated according to the applicable regulations.

3.11. Until the payment is made for the ordered Ticket, the Service User may at any time and at no cost cancel the purchase of the ordered Ticket by leaving the Payment Website and deleting the ordered Ticket from the subpage of the Website entitled "Your cart". Thus, the Service Agreement for the sale of Tickets for film screenings at the Cinema is terminated.

3.12. The agreement for the provision of the Service consisting in the sale of Tickets for film screenings at the Cinema is also terminated in the case specified in paragraph 4.4 of the Terms and Conditions.

3.13. The Service Provider is not responsible for the incorrect data given by the Service User when ordering the Ticket. The Service Provider informs the Service User that providing inaccurate personal data may result in not providing the Customer with the Ticket or inability to process the Ticket.

3.14. After placing an order for a Ticket, the Service User has the right to resign from purchasing the ordered Ticket by not making a payment for it. In such a case, the order shall be cancelled in accordance with point 4.4 of these Terms and Conditions. 

     

    4. PAYMENT

    4.1. Payment for a Ticket ordered through the Website will be possible only through the Payment Website, to which the Service User will be redirected immediately after placing the order.

    4.2. The Service User can only pay for the ordered Tickets using the payment methods made available on the Payment Website.

    4.3. Payment resulting from one order should be made in one go, in full, and include the price of all ordered Tickets together with their delivery cost. The Service User is not entitled to make payments in instalments or separately for individual Tickets.

    4.4. Payment should be made no earlier than at the time of order and no later than 15 minutes after placing the order. After the deadline for payment, the unpaid order shall be cancelled, of which the Service User will be informed by an e-mail sent to the e-mail address specified in the order. The moment the payment is made and the ticket is purchased is the moment the Service Provider receives information that the payment has been made. As a result of cancelling the order, the Service Agreement for the sale of Tickets for film screenings at the Cinema is automatically terminated and the Service User does not bear any costs on this account.

    4.5. In the case that the Service Provider does not receive confirmation of the availability of the funds necessary to pay the transaction price from the administrator of the Payment Website within 30 minutes of placing the order, or if they receive information that the funds necessary to complete the transaction are not available, the Service Provider will inform the Service User that the transaction cannot be completed.

     

    5. TICKET DELIVERY AND COLLECTION 

    5.1. Once payment has been made, the Service User will receive the Ticket in accordance with the delivery method chosen during the placing of the order for the Ticket:

    1. via e-mail – approximately 5 minutes after making the payment, but no later than 20 minutes from placing the order, an e-mail message containing the Ticket in the form of a photo code saved in a PDF file will be sent to the e-mail address provided by the Service User. The realisation of a Ticket delivered via email requires printing the Ticket in black on white paper or presenting it on a device with a displayed photo code;
    2. or collecting it at a ticket office in accordance with paragraphs 6.1.-6.7. of these Terms and Conditions.

    5.2. The equipment necessary to use the Ticket sent to the Service User by e-mail is:

    1. a device with the access to the Internet and with software supporting files in PDF format,

    alternatively, in the case of a printed ticket:

    1. a computer printer with black ink and white paper.

    5.3. The Ticket is redeemed by presenting it to the Cinema employee at the ticket gate;

    1. Ticket – in the form of a black printout on white paper, or in the form of a photo code displayed on the device, or in the form of a paper ticket collected at a ticket office in accordance with paragraphs 6.1-6.7 of these Terms and Conditions, 

    5.4. A Ticket is valid from the moment it is received upon payment until the end of the film screening it refers to. The Service User shall have no right to participate in the film screening at the Cinema outside the validity period of the Ticket. Ticket can be collected at the Cinema ticket office within the time specified in point 6.3. of these Terms and Conditions.

    5.5. The Service User is obliged not to make the Ticket available to third parties. If several people show up at the Cinema with the same Ticket, only the person who redeemed the Ticket first will be entitled to participate in the film screening.

    5.6. In case the Service User leaves the screening room during the film screening, they shall present the Ticket to the Cinema employee as specified in 5.3, under pain of losing the right to return to the screening room and participate in the further part of the film screening.

     

    6. COLLECTING THE TICKET AT A CINEMA TICKET OFFICE 

    6.1. A Service User who, when placing an order for a Ticket, has chosen the method of delivery in the form of collecting it from a ticket office or who, for any reason, is unable to present the Ticket in the way specified in paragraph 5.1. of these Terms and Conditions, has the option of collecting it from a Cinema ticket office on the principles specified in paragraphs 6.2-6.7;

    6.2. The Ticket can only be collected at a Cinema ticket office by the Service User in person.

    6.3. Tickets can be collected at a ticket office no later than 15 minutes from the start of the film screening to which the Ticket relates.

    6.4. The Service User is not entitled to priority in collecting a Ticket over other customers of the Cinema who purchase or collect their tickets directly at a cinema ticket office.

    6.5. In order to pick up the Ticket at a Cinema ticket office, the Service User is required to provide the transaction number specified in the order confirmation. If the Service Provider has any doubts about the Service User identity, they may ask the Service User to produce an identity document and give their e-mail address or mobile phone number which was given in the order.

    6.6. The Service User is obliged not to disclose the transaction number to third parties. If several people show up at the cinema box office with the same transaction number, only the person who picked up the Ticket first will be entitled to collect the Ticket and attend the film screening.

    6.7. Service Provider is not responsible for the inability to pick up Ticket at a cinema ticket office for the reasons beyond their control: in case of temporary or permanent loss of connection with the IT system verifying the receipt of payment by the Service User and in case of inability to pick up Ticket within the period specified in paragraph 6.3. of these Terms and Conditions due to the queue at a Cinema ticket office.

     

    7. RETURNING THE TICKET 

    7.1. A Ticket that is not redeemed in the manner indicated in paragraph 5 of these Terms and Conditions or collected at a Cinema ticket office in the manner indicated in paragraph 6 of these Terms and Conditions is non-refundable, unless the provisions of this paragraph state otherwise.

    7.2. The Service User has the right to return the Ticket:

    1. in the event of the cancellation of a film screening to which the Ticket relates or a delay of at least 30 minutes in the commencement of the screening,
    2. in case of other circumstances which make it impossible to realize the purchased Ticket due to the Service Provider fault, subject to the provisions of paragraph 7.3.

    7.3. The right to return a Ticket is not applicable in particular:

    1. in the case of changing the screening room, in which the film will be shown, with the Service Provider agreeing that the seat assigned to the Ticket in the new screening room will be similarly located (in relation to the screen) to the seat selected by the Service User,
    2. in the event of a delay of less than 30 minutes in the commencement of a film screening,
    3. in the case specified paragraph 6.7. of these Terms and Conditions.

    7.4. The Service User should return the Ticket to a Cinema ticket office no later than on the day of the film screening the Ticket was purchased for, and not later than before the screening starts, or electronically, in accordance with paragraph 7 of these Terms and Conditions – within 14 days from the day of purchasing the Ticket, and not later than before the screening the Ticket was purchased for.

    7.5. When returning a Ticket, it is necessary to present the Ticket, identity document and transaction number specified in the order confirmation, e-mail address and telephone number.

    7.6. In the case of returning the Ticket at a Cinema ticket office, the Service User shall receive a refund of the payment made at a ticket office in cash, immediately after the validity of the ticket return is verified by an employee of the Service Provider. In the case of an unjustified return, the Service User shall be informed at a Cinema ticket office about the reasons for the refusal of the request.

    7.7. In the event of the screening cancellation, the Service Provider shall make every effort to immediately inform the Service User of this fact in the form of an e-mail sent to the address specified in the order.

    7.8. Pursuant to Article 38(12) of the Act of 30 May 2014 on Consumer Rights, the right to withdraw from an agreement concluded off-premises or remotely is not granted to a consumer in relation to an agreement for the provision of services related to entertainment, sports or cultural events, if the agreement specifies the day or period of service provision. Therefore, the Service User who is a consumer within the meaning of the Act of 30 May 2014 on Consumer Rights, is not entitled to withdraw from the agreement concerning the purchase of a Ticket on the basis of Article 27 of the Act of 30 May 2014 on Consumer Rights.

     

    8. COMPLAINTS PROCEDURE 

    8.1. Any questions, comments and complaints regarding the Services should be sent by e-mail to sprzedaż@festiwalgdynia.pl. Questions, comments, and complaints regarding payments should also be submitted via the website www.dotpay.pl.

    8.2. The complaint should contain the first name, surname, the exact address of the Service User, e-mail address, and a detailed description and the reasons for the complaint.

    8.3. Complaints will be dealt with by the Service Provider within 14 (fourteen) days of the date of submission.

    8.4. The person submitting the complaint will be informed about the method of complaint processing using the contact data indicated in the complaint form.

    8.5. If the data or information provided in the complaint needs to be supplemented, before the complaint is considered, the Service Provider shall request the complainant to supplement it in the indicated scope. 

     

    9. PERSONAL DATA 

    9.1. As part of the provision of services by electronic means, the Organiser is entitled, pursuant to Article 18(1) of the Act on Providing Services by Electronic Means, to process the User personal data necessary to establish, shape the content of, amend or terminate the agreement for the provision of services by the Organiser and solely for the purpose of proper realisation of the Services.

    9.2. If the Organiser obtains information on the Service User use of the Services in a manner contrary to the law or to these Terms and Conditions, the Organiser may process the Service User personal data for the purpose and to the extent necessary to establish the Service User liability.

    9.3. The Organiser may process, i.a., the following personal data:

    • surname and first name of the Participant,
    • login,
    • residence or correspondence address,
    • e-mail address,
    • phone number.

    9.4. The Organiser may also process the following data which characterise the User use of the Service (exploitation data):

    • designations identifying the Service User that are assigned on the basis of the data referred to in paragraph 3 of this section,
    • designations identifying the telecommunications network termination point or the data communications system used by the Service User,
    • information on the commencement, termination, and scope of each use of the Services,
    • information about the use of the Services by the Service User.

    9.5. The Organiser is the administrator of personal data within the meaning of the Personal Data Protection Act.

    9.6. The Organiser, as data administrator, cares about the security of the personal data provided by the Service Users. These data are protected from access by unauthorised persons.

     

    10. FINAL PROVIONS 

    10.1. The Service Provider is not responsible for the functioning of GSM networks, Internet networks through which Tickets are ordered, booked or delivered to the Service Recipients.

    10.2. The Service Provider is not responsible for the operation of the Internet network through which the Service Users place orders and receive Tickets. The Service Provider is not responsible for the settings of the Service User computers or other devices of an individual nature and the manner in which they are configured, as well as settings or interruptions in the provision of services by the Service User Internet access providers.

    10.3. These Terms and Conditions are available to the Service Users at the Service Provider head office, Cinema ticket offices and at www.system.festiwalgdynia.pl.

    10.4. The Service Provider hereby reserves that these Terms and Conditions may be amended at any time. The date of change of these Terms and Conditions will be the date of publication of the new version of the Terms and Conditions on the Website and at Cinema ticket offices. In the case of changes to these Terms and Conditions, the Service Provider undertakes to post information about this fact on the Website at least 7 days in advance.

    10.5. The Service Provider reserves the right to:

    1. decide on the content of the Website, make changes and modifications to it, without having to inform the Service User of their intentions;
    2. temporarily suspend the operation of the Website and temporarily suspend the ability to purchase all or some of the Tickets via the Website and to book Tickets.

    10.6. If mandatory provisions of law constitute different rights and obligations of the Service User and the Service Provider than the provisions of these Terms and Conditions, the mandatory provisions of law shall apply.
